Your use of the services and products is at your own risk, and you are solely responsible for any damage to your device or loss of data resulting from such use.

Some jurisdictions may not allow the exclusion of certain warranties. In those cases, our liability will be limited to the extent permitted by applicable law.

7. Limitation of Liability

To the maximum extent permitted by applicable law, Play is the Portal LLC, Truth or Play LLC, and their affiliates, directors, officers, employees, agents, contractors, and licensors will not be liable for any:

Indirect, incidental, special, punitive, or consequential damages.
Loss of profits, revenue, data, goodwill, or business opportunities.
Damages arising out of or related to your access to, use of, or inability to access or use our services or products.

This limitation applies regardless of the legal theory under which such damages are claimed, including contract, tort (including negligence), strict liability, or otherwise, and even if we have been advised of the possibility of such damages.

In jurisdictions that do not allow the exclusion or limitation of certain types of damages, our liability will be limited to the fullest extent permitted by applicable law. In no event shall the aggregate liability of Play is the Portal LLC and Truth or Play LLC for all claims related to your use of our services or products exceed the amount you have paid us, if any, in the twelve (12) months preceding the event giving rise to the claim.

8. Governing Law

These Terms and any disputes or claims arising out of or related to them, or your use of our services or products, are governed by and construed in accordance with the laws of the State of Washington, United States, without regard to its conflict of laws principles.

By using our services, you agree that any legal action or proceeding related to these Terms shall be brought exclusively in the state or federal courts located within the State of Washington. You consent to the jurisdiction of and venue in such courts and waive any objection to such jurisdiction or venue on the grounds of inconvenience or otherwise.

If any provision of these Terms is found to be unenforceable under applicable law, the remaining provisions will remain in full force and effect.

Warranty

Warranty Coverage

Play is the Portal LLC warrants that the “Truth or Play” card game (the “Product”) purchased directly through our official online store or authorized retailers will be free from manufacturing defects in materials and workmanship for a period of 30 days from the date of delivery, as confirmed by shipment tracking information. This warranty applies only to the original purchaser of the Product and is non-transferable.

If a defect arises within the warranty period and is confirmed by Play is the Portal LLC, we will, at our sole discretion:

Repair the defective Product,
or
Replace the defective Product with an identical or functionally equivalent product,
or, where required by law or deemed appropriate by us,
Provide a refund of the purchase price.

This warranty applies only to manufacturing defects and does not cover damage caused by misuse, improper handling, accidents, modifications, unauthorized repairs, exposure to moisture or extreme conditions, or normal wear and tear.

To initiate a warranty claim, the purchaser must contact us at team@truthorplaythegame.com within the 30-day warranty period and provide:

Proof of purchase.
A detailed description of the defect.
Photos or other documentation if requested.

We may require the return of the defective Product for inspection before processing a claim.

Who Is Covered

This warranty extends only to the original purchaser of the Product who acquired it:

Directly through the official Play is the Portal or Truth or Play online store, or
Through an authorized retailer.

The warranty does not cover individuals who obtained the Product:

Through unauthorized sellers or third-party resellers,
As a second-hand purchase, or
Through any channel not recognized as an authorized seller.

To qualify as an original purchaser, you must provide valid proof of purchase, such as a receipt, order confirmation email, or equivalent documentation. We reserve the right to deny warranty claims where proof of purchase is not provided or is insufficient to confirm eligibility.

What Is Covered

This warranty covers:

Defects in material or workmanship of the Product that arise under normal use during the warranty period.
Manufacturing errors, faulty components, or other production-related issues that render the Product unusable or significantly impaired.

If a defect is identified and a valid claim is submitted within the warranty period, Play is the Portal LLC will, at its sole discretion:

Repair the defective Product,
Replace it with an identical or functionally equivalent Product, or
Issue a refund of the purchase price, where required by law or deemed appropriate by us.

Repairs or replacements may utilize new or remanufactured products or parts that meet the quality standards of the original Product.

What Is Not Covered

This warranty does not cover:

Normal wear and tear, such as fading, scuffs, small scratches, or minor imperfections that do not affect the functionality of the Product.
Damage caused by misuse, abuse, neglect, improper handling, or failure to follow care and usage instructions.
Damage resulting from exposure to moisture, extreme temperatures, or environmental conditions inconsistent with normal indoor use.
Alterations, modifications, or repairs made by anyone other than Play is the Portal LLC or its authorized parties.
Dissatisfaction with design, artwork, gameplay experience, or personal preferences.
Products purchased from unauthorized sellers, third-party resellers, or as second-hand items.

This warranty is strictly limited to manufacturing defects and does not include liability for incidental, consequential, or special damages, to the fullest extent permitted by applicable law.

Warranty Start Date

The 30-day warranty period begins on the date of delivery of the Product, as confirmed by the shipment tracking information provided by Play is the Portal LLC or its authorized shipping carrier.

If the delivery date cannot be verified, the warranty period will begin seven (7) calendar days from the date the Product was shipped.

Shipping Costs for Returns

If a defect is confirmed under this warranty, Play is the Portal LLC may reimburse the purchaser for reasonable return shipping costs upon request, provided that:

The purchaser initially covers the cost of shipping the defective Product to us for inspection.
The defect is verified upon inspection by Play is the Portal LLC.
The purchaser uses a standard, non-expedited shipping method (such as ground shipping).
The purchaser submits proof of shipping costs (receipts or equivalent) within 14 calendar days of the return shipment.

Expedited or premium shipping costs will not be reimbursed unless explicitly authorized in advance by Play is the Portal LLC.

If no defect is found or the warranty claim is deemed invalid under the terms of this warranty, the purchaser will be responsible for all shipping costs, including the cost of returning the Product to the purchaser, if requested.

We are not responsible for lost or damaged shipments during the return process. We encourage purchasers to use a trackable shipping service and consider purchasing shipping insurance where appropriate.

Timeline for Resolution

Once Play is the Portal LLC receives the returned Product, we will:

Inspect the item and evaluate the warranty claim.
Provide an update on the status of the claim within 10 business days.

If the claim is approved, we will:

Repair the defective Product,
Replace it with an identical or functionally equivalent Product, or
Issue a refund of the purchase price, as applicable.

Repairs, replacements, or refunds will typically be processed within 14 business days from the date the claim is approved. If additional time is required due to product unavailability, shipping delays, or other circumstances, we will notify the purchaser with an updated timeline.

Limitation of Liability (Warranty)

To the fullest extent permitted by applicable law, the liability of Play is the Portal LLC and Truth or Play LLC under this warranty is strictly limited to the purchase price of the Product.

Under no circumstances shall Play is the Portal LLC or Truth or Play LLC be liable for:

Indirect, incidental, special, punitive, or consequential damages.
Lost profits, lost revenue, loss of data, loss of business opportunities, or loss of goodwill.
Any claims arising out of or related to the use, misuse, or inability to use the Product, or delays or failures in performance due to circumstances beyond our reasonable control.

Certain jurisdictions may not allow the exclusion or limitation of incidental or consequential damages. In such cases, the limitations will apply to the maximum extent permitted by law.

Force Majeure (Warranty)

Play is the Portal LLC shall not be responsible for any failure or delay in fulfilling its warranty obligations caused by circumstances beyond its reasonable control, including but not limited to:

Acts of God, natural disasters, fires, floods, or earthquakes.
Pandemics, epidemics, or public health emergencies.
Governmental actions, restrictions, or regulations.
Labor disputes, strikes, or shortages of materials or labor.
Supply chain disruptions, power outages, or transportation delays.
Acts of war, terrorism, or other unforeseen events.

In such cases, we will make reasonable efforts to notify the purchaser of the situation and provide an updated timeline for resolution. This clause does not extend the warranty period but may delay resolution timelines in extraordinary circumstances.

Exclusions Clarification

To avoid confusion, this warranty does not cover:

Cosmetic imperfections, minor defects, or normal wear that occurs through standard use (such as box corner wear, small scuffs on cards, slight discoloration).
Damage from accidents, spills, bending, tearing, or other mistreatment not consistent with normal gameplay.
Damage resulting from failure to follow care or storage instructions (e.g., storing in damp areas or direct sunlight for prolonged periods).

This warranty focuses on manufacturing defects that significantly affect the usability of the Product as a card game.

International Customers

For customers residing outside the United States:

Warranty claims may be subject to additional costs and conditions, including international shipping fees, taxes, customs duties, or other charges.
The purchaser is responsible for covering these costs unless otherwise agreed in writing by Play is the Portal LLC.
We are not liable for delays caused by customs clearance, international shipping logistics, or other regulatory processes in the purchaser’s country.

Replacement Products shipped internationally may also be subject to additional shipping or customs fees, which are the responsibility of the purchaser. All international warranty claims must comply with applicable laws and regulations in the relevant country.

Proof of Purchase

To validate a warranty claim, the purchaser must provide proof of purchase, which may include:

The original receipt.
An order confirmation email.
A bank or credit card statement clearly showing the transaction, date, and merchant.

The proof of purchase must clearly include:

The purchaser’s name.
The date of purchase.
Details of the Product.
The name or website of the authorized seller.

Warranty claims submitted without valid proof of purchase may not be processed. Play is the Portal LLC reserves the right to request additional documentation if needed to verify eligibility.

Environmental Responsibility

Warranty Disclaimer

Except as expressly provided in this warranty, Play is the Portal LLC and Truth or Play LLC make no other warranties, express or implied, including but not limited to:

Implied warranties of merchantability.
Fitness for a particular purpose.
Non-infringement of third-party rights.

This warranty is the sole and exclusive remedy provided for the Product. No other oral or written information, statements, or representations made by Play is the Portal LLC, Truth or Play LLC, their employees, agents, or affiliates shall create any additional warranty or alter the terms of this warranty.

In jurisdictions where the exclusion or limitation of implied warranties is not permitted, any implied warranties required by law are limited in duration to the length of this express warranty, unless otherwise required by law.

Your rights under this warranty are in addition to any rights you may have under applicable consumer protection laws in your jurisdiction. This warranty does not limit or exclude those rights except to the extent allowed by law.

By purchasing or using the Product, the purchaser acknowledges and agrees that this warranty supersedes any other warranties, terms, or conditions, express or implied, to the fullest extent permitted by law.

Dispute Resolution (Warranty)

If a dispute arises regarding a warranty claim or any other matter related to the purchase or use of Play is the Portal LLC or Truth or Play LLC products, the purchaser agrees to first attempt to resolve the issue informally by contacting us at team@truthorplaythegame.com. Both parties will make a good-faith effort to resolve the matter through communication.

If the dispute cannot be resolved informally, the parties agree to submit the matter to binding arbitration, administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration will be the exclusive method of dispute resolution, and the purchaser waives the right to file a lawsuit in court, except for claims that may qualify for small claims court.

The arbitration will take place in Seattle, Washington, unless the parties mutually agree on a different location, and will be governed by the laws of the State of Washington, without regard to its conflict of laws provisions. Each party is responsible for its own legal fees and arbitration costs, unless otherwise required by applicable law or the AAA’s rules.

Any claim or dispute must be filed within one (1) year from the date the cause of action arises, unless a longer period is required by law. Claims filed beyond this period will be barred.

Nothing in this clause prevents either party from bringing a qualifying claim in small claims court within the appropriate jurisdiction.

Consumer Rights Notice

This warranty is offered as the sole and exclusive warranty for the Product and is provided in accordance with applicable consumer protection laws. While this warranty is designed to address manufacturing defects in the Product, it is not intended to limit any non-waivable rights provided by law, except to the extent permitted by applicable regulations.

To the fullest extent allowed under applicable law, this warranty limits remedies to those expressly stated herein and excludes all other remedies or rights, including claims related to dissatisfaction with the Product or minor imperfections that do not affect functionality.

Any rights provided under consumer protection laws that cannot be waived or limited by contract remain unaffected.

No Refund Policy

Please note that Play is the Portal LLC does not offer refunds for the Truth or Play card game except as required by law or as expressly provided under this warranty. Our standard remedy for eligible warranty claims is repair or replacement of defective items.

If you believe you have received a defective Product, please contact us promptly to facilitate a warranty claim.

The purchase of any Product from Play is the Portal LLC or Truth or Play LLC is intended solely for personal use and does not grant you any rights to:

Distribute the Product or its contents beyond personal, non-commercial use.

The content does not infringe on the rights of any third party, including privacy, publicity, or intellectual property rights.

We reserve the right to remove or refuse any submitted content at our sole discretion.

Refund and Replacement Policy

All sales of Products from Play is the Portal LLC and Truth or Play LLC are final, subject to our warranty for manufacturing defects and any non-waivable rights under applicable law.

We do not provide refunds for dissatisfaction with gameplay, design, or subjective experience.
Products found to be defective due to manufacturing issues may be eligible for repair or replacement in accordance with our warranty terms.
Requests for refunds or replacements outside the scope of our warranty will generally not be honored, unless required by law.

Indemnification

Arbitration (General)

Any disputes arising from or related to the use of the Product, services, or these Terms (beyond warranty-specific disputes already addressed) shall be resolved exclusively through binding arbitration, administered by the American Arbitration Association (AAA) under its rules.

The arbitration shall take place in Washington State.
The arbitrator’s decision will be final and binding on all parties.
By using the Product or services, you waive your right to a trial by jury and to participate in any class action lawsuit, except where such waiver is prohibited by law.

Force Majeure (General)

Play is the Portal LLC and Truth or Play LLC shall not be liable for any delay or failure to perform obligations under these Terms or related agreements due to events beyond their reasonable control, including but not limited to:

Natural disasters, pandemics, or public emergencies.
Government actions, labor disputes, or supply chain disruptions.
Technical failures, power outages, or acts of war or terrorism.

We will make reasonable efforts to resume performance as soon as practicable once the force majeure event has subsided.

Updates and Revisions Clause

Play is the Portal LLC and Truth or Play LLC reserve the right to revise, update, or modify these Terms, disclaimers, and related policies at their sole discretion. Any changes will take effect immediately upon being posted on the website, unless otherwise stated.

It is your responsibility to review these Terms periodically for updates. Continued use of the Products or services following any changes constitutes acceptance of the revised Terms.
